Lori Vallow Daybell trial in Idaho, which was supposed to start in January, has been delayed, according to District Judge Steven Boyce, because “the Court sees no other alternative at this time.”Instead, a hearing to evaluate Lori Vallow Daybell’s competency will be scheduled to assess his mental state.
Along with her fifth spouse Chad Daybell, Vallow Daybell has been charged with first-degree murder and conspiracy to commit murder in connection with the 2019 murders of her children Tylee Ryan and J.J. Vallow.In addition, Tammy Daybell, who was Chad Daybell’s first wife before Lori, was charged with first-degree murder.To their allegations, the pair has each entered a not guilty plea.
According to East Idaho News, defense attorneys John Thomas and Jim Archibald submitted a motion to postpone Lori Vallow Daybell’s trial on Monday, stating that the deadline for any documents pertaining to her mental state was October 11.On November 9, a pretrial hearing had been scheduled.
According to reports, Archibald stated in the document that “none of the specialists consulted by the Court and the State of Idaho Department of Health and Welfare allege she is malingering or fabricating her mental illness.”She is aware that she will go through more mental health tests.Daybell’s legal team has also asked that his trial be delayed and held separately from Vallow Daybell’s.
The couple’s joint trial was supposed to take place in January.The outcome of Vallow Daybell’s case may or may not affect the outcome of Daybell’s trial.
